【申込受付終了】移住連全国ワークショップ2023 in 広島(6月10日〜11日)

日本社会はすでに多くの外国人労働者、国際結婚などでの定住者や外国ルーツをもつ子ども・若者らが暮らす移民社会となっており、地域では共生に向けたさまざまな取り組みが始まっています。その一方で、日本政府は、従前のままの外国人管理と非正規滞在者の排除、使い捨て労働力としての外国人労働者受入れ政策を変えようとしません。

今年の広島での2日間のワークショップでは、地域から広がる移民社会の実態や取り組みの報告をうけ、課題別テーマでの討論をしながら、共感を阻む制度・政策の壁を打ち破るために何ができるか、について議論を深めていきたいと思います。

分科会1:労働・技能実習・特定技能 
「技能実習制度廃止の先をみすえて〜外国人労働者の現状と課題」

 政府は、昨年12月、「技能実習制度及び特定技能制度の在り方に関する有識者会議」を設置し、本年4月28日には中間報告書がとりまとめられました。

 中間報告書では、「現行の技能実習制度は廃止して人材確保と人材育成(未熟練労働者を一定の専門性や技能を有するレベルまで育成)を目的とする新たな制度の創設(実態に即した制度への抜本的な見直し)を検討」するとされていますが、詳細に検討すると、技能実習制度が抱える本質的な問題は見直されず、技能実習制度廃止後の新制度においても、技能実習制度で生じていることと同様の問題が生じる危険性があります。

 本分科会では、移住連が本年1月18日に有識者会議のメンバーから受けたヒアリングの際に主張した意見を踏まえ、技能実習制度、特定技能に限らず、広く、現場で起こっている外国人労働者が抱える問題を、各報告者による報告によって共有し、①受入れ制度について、②日系人を含むその他の労働者の問題(就労、支援の在り方)、③労働組合としての課題の3つのグループに分かれて議論をします。

分科会2:難民・収容と非正規滞在者の生存権 
「生存権保障への道~難民、在留許可基準の転換、そして正規化を求めて」

入管庁は、2015年以降は収容を強化するための通知・指示を連発し、2023年には送還強化と罰則、難民の送還停止効を制限し、難民申請中でも送還を可能とする改悪法案を出してきました。しかし、「送還忌避者」の増加は、難民認定基準や在留特別許可基準が国際人権基準に沿うものとなっていないことが根本の原因です。また、入管収容中の健康破壊や非正規滞在者の生存権破壊も深刻化の一途をたどっています。

本分科会では、難民・収容の課題に取り組む人と、医療・福祉・社会保障、そして貧困の課題に取り組む人とが協働し、難民認定基準と在留特別許可基準の転換、そしていま非正規滞在に置かれている移民難民の生存権獲得、「正規化」にむけた取り組みについて論議していきます。

分科会3:自治体施策 
「地方自治体と外国人住民施策」

 外国人住民が300万人を超える現在でも、自治体の外国人住民に対する施策は低調です。とりわけ2020年から始まったコロナ・パンデミックは、社会的、経済的に脆弱な位置に置かれていた移民・難民の命と暮らしを直撃し、その「コロナ禍」が今なお続いています。

 いまだ地方参政権を認められていない外国人住民は、地方自治に積極的に参画することも、自分たちの生活上の要求を地方自治行政に反映させる回路も保障されていません。さまざまなところで「泣き寝入り」を余儀なくされています。

このような不平等、不公平な取り扱いに対して、外国人住民に対する社会保障や公務就任権、地方自治参画を自治体に求める闘いが始まっています。また、反ヘイト人権条例制定の取り組み、政府に「多文化共生社会基本法・外国人処遇基本法」の策定を求める市議会意見書など、地域から多民族・多文化共生社会を構想する取り組みが行われています。

 各地の報告者から発題を受けて、これらの取り組みを今後、「共同の闘い」としてどのように押し上げていくのかを一緒に考えていきます。

分科会4:女性 
「移民女性が抱える困難と新しい支援制度 〜困難女性支援法をどう使う?」

コロナ禍を契機に顕在化した女性が抱える困難により、移民女性たちは、在留資格や言葉の壁など固有な問題が加わって、苦境に立たされています。

1 困難な問題を抱える女性の支援法

20244月に施行されるこの新法は、その基本方針に「年齢、障害の有無、国籍等を問わない」と明記しています。移民女性当事者やその支援者がこの新法をどう活用できるか、また施行までに制定されることになっている基本計画に移民女性の実情をどう反映させるかについて、報告者からの発題を受け、参加者で討論をします。

 さらに、以下のテーマについても、取り上げます。

2 改定DV防止法

20213月に名古屋入管で凄惨な死を遂げたスリランカ女性ウィシュマさんはDV被害を受けて警察で助けを求めたにもかかわらず、非正規滞在で収容されDV被害からの救済を受けることもできませんでした。DV防止法が制定されてすでに20年余。今国会での「DV防止法」改正で移民女性への支援拡充ができるのか、残された課題は何か、討論します。

3 離婚後の共同親権導入

法制審議会の家族法制見直しの中で審議されている「離婚後の共同親権」導入問題について、移民女性の立場に立った報告、討論をします。

分科会5:子ども・若者 
「移民の子ども・若者の学びと進路を保証する」

 日本語教育、高校入試の課題など、広島からの地域報告を行います。また、子ども若者の安定した在留の保障について考えます。安心して学びと進路選択が見込まれる在留資格「定住者」「永住者」と、いつ在留が打ち切られ、帰国されるかわからない状態に置かれ、進路選択もままならない在留資格「家族滞在」等、さらには在留資格のない子どもたちと、幾重にも階層が分断された状態を打破するための方策を考えます。
 またディスカンションでは、参加者から、外国につながる子ども・若者支援のためのさまざまな取り組みについて、情報交換をしながら、多文化共生への道を探ります。

各地教委・自治体・団体で作られている、ハンドブック、ガイドブック、Q&A集などを素材に情報交換しながら、地域でできる取り組みを考えます。

分科会6:相談・伴走支援 
「伴走支援、どうしてる?―民間による支援の「限界」と「挑戦」」(オンライン参加可)

移住連では、2021年度・2022年度に、コロナ禍で困難に直面する移民・難民への支援を対象とした相談・伴走支援事業を実施しました。「伴走支援」の実施により、一定数課題の解決や相談者の状況の改善がはかられた一方で、公的制度から排除されている移民・難民への支援は、複合的な課題に加え、財政支援も必要となるなど、現場は「限界」ととなりあわせの状況です。

本分科会では、相談・伴走支援事業に参加のあった「伴走者」からの報告を踏まえながら、支援の取り組みや現状について共有し、民間による支援の価値とその可能性について話し合います。

Session1  Labour, TITP and Specified Skilled Worker(SSW)

"Looking beyond the abolition of the TITP - the current situation and challenges for foreign workers in Japan"

There are approximately 2 million foreign workers in Japan. Of these, the direction of reform of the TITP and the SSW is currently being discussed in the Government's Expert Committee on the Future of the TITP and the SSW. Apart from these systems, the 'acceptance' of care workers with the residence status of 'Nursing Care', and the 'acceptance' of domestic workers under the National Strategic Special Zone system are also in progress. This breakout session will focus on foreign workers coming to Japan due to the 'labour shortage'. We will first receive reports from supporters about the current situation and problems in each system, and then discuss what kind of  'acceptance' system is ideal.  

Session2  Refugees, Detention, and the Rights to Life of Undocumented Persons

"The path to guaranteeing the rights to life: a call for a shift in refugee recognition and residence permit criteria, and regularisation"

Since 2015, the Japanese Immigration Agency has issued a series of notices and instructions to strengthen detention, and in 2023 it has proposed a revised bill to strengthen deportation and penalties, limit the effect of suspension of deportation for refugees, and allow deportation even while a refugee application is in progress. However, the increase in the number of people who refuse deportation is rooted in the fact that refugee recognition criteria and special residence permit criteria are not in line with international human rights standards. In addition, the destruction of health during immigration detention and the destruction of the right to life of irregular migrants are becoming increasingly serious.

In this session, those working on the issues of refugees and detention, healthcare/welfare/ social security, and poverty will gather to discuss the improvement of the criteria for refugee recognition and special residence permit, and the efforts towards the acquisition of the right to life and 'regularisation' of migrants and refugees in an irregular situation.

Session3   Municipal Policies

"Local municipalities and their policies for foreign residents"

Even though the number of foreign residents exceeds three million in Japan, local municipalities' measures for foreign residents are still insufficient. The pandemic that started in 2020 hit the lives and livelihoods of migrants and refugees who have been in vulnerable social and economic positions even before. Its impact is still affecting those people. This breakout session will consider the possibility of future 'joint efforts' at the local level based on reports on issues such as social security, education, participation in local governing and anti-hate from rapporteurs from different areas of Japan.  

Session4  Women

"Difficulties faced by migrant women and the new support system - how to use the new law?"

The difficulties faced by migrant women that became apparent due to COVID-19 have been compounded by unique issues such as residency status and language, which have put migrant women in a difficult situation. The new law for supporting women with difficulties, which will come into force in April 2024, states in its basic policy that 'regardless of age, disability, nationality, etc.'. In this breakout session, participants will discuss how migrant women and supporters can make use of this new law, following presentations by rapporteurs. In addition, there will be reports and discussions on the revision of the Act on the Prevention of Spousal Violence and the Protection of Victims submitted to the current Diet and the expansion of support for migrant women, as well as the issue of introducing 'joint custody' after divorce, which is being deliberated at the Legislative Council.  

Session5  Children and Youth

"Ensuring education and career paths for migrant children and youth"

Regional reports from Hiroshima will be presented on issues such as Japanese language education and high school entrance examinations. Also, We will discuss how to guarantee stable residency for children and youth in Japan and consider measures to break down the multiple layers of division between residency statuses, 'permanent resident' or 'long-term resident' status, which is relatively stable and able to study and choose a career path without worries, 'dependent (family stay)' status, which can be terminated at any time and difficult to choose a career path, and “irregular” status.  

Session6  Consultation and Assistance Support(online available)

"How do you do assistance support? -'Limits' and 'challenges' of support by the civil society"

In 2021 and 2022, SMJ implemented the consultation and assistance support project targeting support for migrants and refugees facing difficulties due to the COVID pandemic. While the implementation of the 'assistance support' has resolved a certain number of issues and improved the situation of those consulted, still many of those are excluded from the public system and the support for them is at a crossroads, as they face the complex challenges and often financial support is required. In this session, based on reports from 'assistance supporters' who have participated in the support project, we will share information on support initiatives and the current situation, and discuss the value and potential of support by civil society.
